Bonnie Leipold LS311-37COBL Business Law Kaplan University March 12, 2013 In the case Baker v Osborne Development Corp. , Baker would be able to sue the builder since the court ruled the contract ambiguous. This was because at one point the contract read, â€Å"shall be decided by the arbitrator† and another point in the same section the contract read, to be determined by the arbitrator or by any court. The arbitration agreement was procedurally and substantively unconscionable, since the arbitration agreement was not included in any contract between the buyer and the builder. The arbitration agreement was contained in a separate document that the buyers were not asked to sign at the time of the property was purchased. The court found substantive unconscionably because it would be very unlikely for the builder to sue the buyer. Arbitration has become more known for court cases t oday.Arbitration not only avoids cost and delays for litigation but it puts the dispute in front of the arbitrator who has the expertise to understand the case. States such as New York, New Jersey have consistently enforced arbitration of disputes governed by the FAA. (Berardo & Clemens, 2012) The NCR Corporation v Korala Associates LTD case said in enforcing a valid arbitration clause the courts must look at the entire contract to determine what goes to arbitration or goes to court.This case had many possible arbitration situations; two of them involved Korala obtaining software owned by NCR, APTRA XFS and S4i. Since only the APTRA XFS was included in the contract, only the situation involving the APTRA XFS software was sent to arbitration by the courts. The issue with S4i software would have to be taken to court. This is also the case with Baker v Osborne Development Corp. , The original contract did not include the arbitration clause in question and the buyers were allowed to sue the development company. The Hardest Decision I Ever Made It was about 3 months ago when everything started; I woke up one day and got ready to go to work. Since it was the summer break my father had asked me if I could help out in the hotel because the receptionist had a surgery and couldn’t come to work for a whole month, so I accepted. I finished getting ready and left. On my way out I stopped by our letterbox because something was stuck there, (A leaf I think). I opened the letterbox and there it was: the leaflet that changed my whole life.That leaflet was not any leaflet: it was a publicity leaflet for the best rhythmic gymnastics club that was moving its training location to the public school near my house. While I was reading the leaflet, it brought back to me the memories of the years in elementary school when all of my friends did rhythmic gymnastics and I was the only one who was forced by her mother to do every single day 3 hours of ballet after school. I would always look at them playing w ith the ribbons they would bring to school or try to teach me how to do a handstand.Flexibility wasn’t a problem since in ballet I needed to be very flexible when doing the jump-split*(it’s when you jump in the air and do a sideways split while you’re in the air) also in my category I was the only girl to be able to do the perfect-split (when you do a sideways or frontal split and lean backwards and forwards with your upper body and touching the ground with your nose). Looking at the paper made me regret even more the decision I had made to quit ballet when I turned 14. The lame excuse was that studying got harder and exams were more frequent, the conclusion was: no more ballet.My mother, after a lot of convincing, accepted my decision and I no longer did ballet. Such a silly decision. I should have continued, because of that most of my flexibility is gone. On the leaflet there was a name and a phone number, it also said the first day of tryouts is free, I had a bsolutely nothing to lose, the tryouts were free, the day of the tryouts I was free, and the place was literately a 5 minutes’ walk from my house. I had no excuse not to go. The time to leave for the tryouts was close and my nerves grew bigger, What if I suck? What if I can’t do the split anymore? What if I get laughed at?All sorts of questions started to pop up in my head at the speed of light, I was really looking forward to it but at the same time I was dreading the minutes that passed by. I took my phone out and dialed my dad’s number to cancel but then it hit me, I was not the only one who was going for tryouts, other girls were going too. Other girls who might have never done rhythmic gymnastics as well! That’s why it is called tryouts, silly me! I took my bag and left the office. The weather outside was sunny but the wind was strong and cold, what’s new! The weather almost always was cold and windy here even though it was still in mid-august .We arrived and entered the building. The school gate was big and somewhat outdated, there were trees blocking the view, only a path made of stones was visible. My dad made his way through the trees and I followed behind. I trusted my father, since when he was in high school, he attended this school. The narrow stone path led to a wide and big playground outdated too, we climbed up the stairs and entered the gymnasium, once inside the teacher greeted us and told me to go over to the girls and introduce myself, I made fast friends with the girls and the lesson started.In all my 12 years of ballet and other hobbies, none made me feel so excited and happy like rhythmic gymnastics. I felt the same feeling of elegance and grace that I had felt in ballet in rhythmic gymnastics, but there was another feeling, a feeling that had been missing in ballet, I felt for the first time that I wasn’t doing it out of obligation for my mom. This commercial was created to target an audience that can recognize Darth Vader and Volkswagens. Issues In Sustaining Tourism Development In Vietnam In recent years, Vietnam has taken great steps in the development of tourism. Tourism is promoted widely by the government because it provides the potential for job opportunities, thus producing income for the country and became a source of revenue for the government. However, the tourism industry can also be seen as a critical force, causing negative outcomes such as congestion, the loss of natural environmental and landscapes and the cultural degradation (Bui, 2009). These problems are becoming an issue towards tourism industry of Vietnam due to the lack of effective planning and proper planning of tourism development. Tourism is claimed to be one of the key elements towards the country economy development with particular attention being placed on infrastructure development, human resources, environmental issues, product development and marketing strategies by the Tourism Master Plan 2001 -2010 (Vietnam Embassy, 2011). Yet, evidence demonstrates a critical need for identifying sust ainable ways of using the tourism resources by avoiding a voracious exploitation of the countrys patrimony as well as to ensure the beneficial trade exchange in the international marketplace and substantial long-term socio-economic benefits. This report seeks to explore how the sustainable tourism development in Vietnam affects its economic, social and environmental with an emphasis placed on the challenges that appear along this process. 2.0 Overview of sustainable tourism in Vietnam Vietnam has a high market potential in the tourism industry with foreign investors showing interest in the country (Mok and Lam, 2000). The introduction of an economic reform policy, doi moi encouraged the establishment of normal political with other countries by lifting the restrictions on investment by the private sector. As a result, Vietnam has experienced a massive growth in the service industry since the Asian financial crisis in 1998. The improving visa policy, the limited transportation networks and the restricted marketing (i.e. tourism promotion budget around S$1m about a tenth the size of the budgets of Singapore) are the three main considerations of accessibility to Vietnam (Suntikul, Butler and Airney, 2008). According to the Vietnam National Administration of Tourism (2010), international visitors to Vietnam reached 449,570 arrivals in 2010, increasing by 19% over the same period last year. The total international arrivals in 2010 reached 5,049,855 representing a 34.8% growth. In terms of market share, China was ranked top, with the largest influx of visitors into Vietnam in 2010, while the South Korea and Japan, at second and third, also dominated the market. Such a number exceeds the carrying capacity in Vietnam, including both its tourist infrastructure and environment and risks serious overcrowding in some cities of attraction e.g. Hue, environmental pollution, degradation of monuments and the collapse of the tourist industry as the result of unsustainable tourism development (Bui, 2009). Since 1995, Vietnam National Administration of Tourism (VNAT) urged the tourism industry to focus on the development of facilities and infrastructure to encourage more investment, while developing a unique tourism product (Vietnam Embassy, 2008). It is also stated that the unsustainable nature of the sector both in terms of use of local resources and tourists arrivals (limited repeat visitors) , which is also reflected by tourism destination being exploited carelessly and by traditional cultures being affected and changed by tourist arrivals. In other words, there is a need to address the Vietnamese tourism sites that have been exploited without proper planning, caring and investing take place in tourism facilities, the conservation and restoration of values of culture, history and landscapes. The ever-increasing annual number of international and domestic tourists coming to Vietnam has been a significant encourage to the industry in its efforts to promote tourism business development in a sustainable manner. (Luong, 2005b) 3.0 Issues faced in sustaining tourism development in Vietnam 3.1 Weak institutional practices Vietnam tourism development is dominated by small-medium enterprise (SMEs) that facing weak institutional practice, low financial capacity and lack of attention about environmental conservation and protection (Bui, 2009). These firms are a distinct group with diverse of needs and associated impacts. The problem in infrastructure and improper solid waste practices and sewage produced from the hundreds of tourism enterprises and the mass market of visitors has caused a serious environment pollution and degradation of cultural heritage. Also, there is a lack of clear stands and procedures to examine its strategies in the development of tourism and policies planning. As a result, the VNAT had to reconsider many of its development targets segments for Vietnam tourism industry in the 21st century. The urge to earn foreign exchange and the lack of a strong institutional fundamental to effectively manage environmental resources had led to many example of unsustainable development (Thang, 2004). The domestic private and international sectors have been supported the development of sustainable tourism in Vietnam because it believed that this new market-oriented mechanism brings with it economic benefits. It can be showed as the participation of the local and international stakeholders in sustainable tourism development is only concentrated in the some popular tourist attraction for e.g. SAPA which believed to generate extra revenue by ensuring a clean, green and attractive tourism destination image. Meanwhile, Vietnam government tried to devote its attention to the management of the environment because the fears a loss of political control over the tourism industry due to its rapid development. Yet, the capacity at district government is very low to cater to need in the huge market of sustainable tourism development. Despite that, each group of stakeholders has different views and concern on their responsibility towards the future of tourism depending on the amount of investment that they spend in each tourism destination. SMEs are often seemed to be more concerned towards their return in investment than the overall impact of their operations on the environment and socio-economic sphere (Cooper, 1997; Briassoulis, 2002; Thang 2004). The participation of SMEs are crucial in creating the modalities in strengthen institutional practice and management that enable sustainable tourism development to success. Adoption of sustainable tourism project requires strong institutional frameworks that can overcome shortage in the potential of the market to ease tourism enterprises especially the SMEs towards more sustainable business practices Other than that, one of the challenges is that the policies and law system are inadequate, inconsistent and not in accordance with the reality of tourism development; there is also a lack of understanding and acknowledgement of international rules and principles (Lloyd, 2003). The weak institutional framework for the tourism industry in Vietnam has characterized by a fairly complex system of policies, laws, ordinances and regulation, issued by line ministries, agencies and provincial governments (Lloyd, 2003; Nhà ¢n Dà ¢n, 2006). It is stated that many existing laws and ordinances are incomplete, not only in terms of coverage but also in terms of lacking documents to guide for implementation (VNAT, 2005; Sam et al., 2001; Nhà ¢n Dà ¢n, 2006). Thus, it is crucial to strengthen the need for sustainable tourism planning and management by emphasizing its structure and processes, that has not yet been fully explored and understood in many developing countries e.g. Vietnam. The strategies for sustainable tourism development made by developing countries often tend to be encumbered by the lack of understanding of the complexity of the tourism industry by stakeholders and a lack of strong institutional frameworks needed for their implementation (Bui, 2000). Thus, the corporation of an incorporated tourism development approach for a region emphasized that sustainable tourism development needs a well established institutional practice that enables the participation and co-ordination of stakeholders. 3.2 Threats to the local community in terms of social-economy factor 3.2.1 Employment for locality The Vietnam tourism industry can also have less positive impacts in providing job opportunities for local communities. The tourism industry might reduce of jobs when national parks, forest, rivers or even rice fields become part of the tourism product/experience whereby local government have set buffer zones in many tourist resorts such as national parks, natural reserves and monuments in order to protect them. As a result, local people are forced to move out of, and thus restricted their living practices in these areas. When tourism development displaces and affects local villagers in this way, it can destroy their traditional employment practices (De, 2002; Ha, 2005). It is worthless to reduce labor costs in some tourism-related services since the private sector has made considerable effort to increase the efficiency of tourism business operation. Another important feature of Vietnams tourism industry is that it is differentiated by small- and medium-scale tourism enterprise. Even though the country has taken actions to decentralize its diversity products and management system, yet the increased involvement of privately owned small enterprises in the tourism industry has resulted in slow employment growth. As most of these enterprises are in family based, thus their overall contribution to national employment has been small. 3.2.2 Arise of income equality in rural areas From the social issues perspective, rapid population growth, inadequate basis services of education and health care and social stratification have emerged widely in Vietnam even though the country has made much effort to use its economic success for social improvements (Bui, 2009). According to Kokko and Tingvall (2005), Vietnam has faced the rising of income inequality over the past decade because some regions are improving and growing tremendously faster than others: average income is rising faster in the cities that have higher concentration of tourists than in rural areas whereby there are significant differences between incomes in lowland areas compared with the remote and mountainous areas which has less concentration of tourist. Another example to look into this issue is through a popular tourism destination in Vietnam, Kim Bong Village is capable to attract the attention of tourist because of its scenic riverside landscape and traditional carpentry workshops. Yet, visitors only tend to stop by in Kim Bong village and undertake a short trip. Despite the tourism potential of the village, Kim Bong does not benefit from the development of tourism and is hindered by the underdeveloped infrastructure. As a result, a high incidence of poverty and a lack of decent employment opportunities are direct consequences of these drawbacks. 3.2.3 Lack of skilled human resources The Asian-Tour project ToR highlighted that there is a lack of professional and skilled staff working in tourism sector. While it is easy to start working in the tourism sector, the long term success depends on the satisfaction of the tourist as client. The problem is especially arising when working with poor local communities, who show a lot of hospitality but do not really know how to serve international visitors. The cultural and language differences are constraining the tourism development in Vietnam. Despite, Vietnam having more than 60 tourism training centers that offer university, vocational and postgraduate training, and many graduates from these centers fail to satisfy their employers requirements (Canh 2002; Luong, 2005b). The quality of tour operators, tour guides and hotels operating staff are at bare minimum of acceptable service levels for foreign tourist which reflected the poor quality standard of tourism training programmes offered in Vietnam. Due to the teaching standard and training programmes vary in each training institution has resulted a considerable of inconsistency in the used of textbooks and curricula. Tour companies claimed that tourism graduates are often poorly equipped with the skills and knowledge they needed in working in the sector, whereby there are insufficient historical and cultural understanding, lack of hospitality skills and poor language proficiency (Vietnam Cultural Profile, 2005). It is stated that the lack of qualified local tour guides wh o speak Asian languages such as Japanese, Chinese and Korean is of particular concern to the VNAT, given their current focus on this area because tourist from China, South Korean and Japan are the top three countries that have visited Vietnam in 2010. For this reason, the industry has to recruit skillful tour guides from outside the sector and trained in post. 3.2.4 Lack of participation of local communities Despite that, the local communities and their leader are rarely included in the strategy, practices and policy making processes relating to sustainable tourism development project which affects their access and business activities to tourism resources. The level of participation of tourism enterprises and the local communities in the control of operation in tourism activities is constrain (De, 2002; Ha, 2005; Dinh et al., 2006). Despite that, however, from the local community point of view, a development and institutional practices might result in a loss of access to tourism resources and unfavorable social activities in the local economy. (Lipscombe Thwaites, 2003). It can be seen that the major constraints to sustainable tourism development in Vietnam is due to the insufficient of communication and co-operation between various authorities, especially with central government developing policies for tourism planning, marketing and promotion of tourism. 3.3 Week awareness of planning and development of tourism facilities It is undeniable that the tourism industry has contributed massively to the economic growth of Vietnam, but in return it has also caused environmental degradation, biodiversity deterioration and the other adverse impacts (Canh, 2002; Lam, 2002). The exploit of natural resources in the supply of tourists facilities can lead to conflicts over resources between the locality and the tourism industry. For example, the Tam Dao tourism site in Vinh Phuc province has become degraded; areas of Trang Tien, opera house or Bac Co in inner of the capital city should have planned into flower gardens rather building of Hilton hotel; beaches in Ha Long Bay of Quang Ninh province has been imposed by Hoang Gia hotel project; Van Phong gulf in Khanh Hoa province is about to become an uncultivated bay because of a shipbuilding plant (Le Minh, 2010) Deforestation and intensified use of the resources can also result in environmental pollution and erosion. Pressures on the environment and tourism resources generated by the development of tourism in Vietnam are excessive. Often, those impacts are due to improper planning, negligent behavior by tourism-related services and tourists, and a lack of education and awareness towards the impacts by many localities. In Vietnam, there have been many national parks cater to both conserve biodiversity as well as tourism attraction. It is risky for mass tourism participates in national parks with fragile forest ecosystems. In addition to the stresses put on the local environment through accommodating the needs and comforts of these tourists: communication routes, provision fuel wood and waste disposal services all put a large stress on the ecology (De, 2002; Luong, 2005a). 3.3.1 Poor infrastructure The poor public infrastructure in Vietnam is a major issue to hotel and tourism. Roads are poor with many potholes and the adequate transport links between the north and south parts of the country. Floods in roads after downpours can be easily seen in tourist destination sites, causing a great deal of inconvenience and bad tourism image to tourists. The railway system is weak and substandard. Trains, still using steam engines, are slow of poor quality. Poor transportation networks and facilities have impeded travel by international tourist within the country (Connie and Terry, 1998). The system infrastructure is poorly developed whereby the transportation, tourism services, information system, telecommunication development are limited in terms of quality. It is important to note that, because of a lack of proper national tourism promotion strategy and its poor infrastructure Vietnam struggles to compete as a tourism destination with some of its more developed neighbors such as Singapore, Thailand, Indonesia and Malaysia (VNAT, 2005). 3.4 Lack of diversified and sustainable tourism product There are many articles appearing on the national newspaper Viet Nam News, emphasizing on tourism potential, development and target markets that became an important source of income to the country which resulted the efforts in advertising and promoting the image of Vietnamese tourism in international networks, and at the same time improving the quality of the current tourism products and services. Yet, minimum attentions have been placed towards the requirement of fundamental diversification in identifying and packaging of a tourism product to cater the different needs and expectations by the domestic, the short-haul Asian and the long-haul European and other international markets. It seems that tourism development in Vietnam can be seen through the construction of more high-rise hotel buildings as well as the emerged of international hotel chain to cope with increasing numbers of visitors, with the lack of attention towards the planning and management of those natural resources that attracted tourists in the first place. 3.5 Weak destination image Those working in the tourism sector argue that the VNAT must implement more promotion towards the country in overseas than just presenting itself at selected international travel trade shows. Currently, the Vietnamese tourism industry has a ratio of 15 percent in repeated international arrivals, which is rather low compared with Singapore, Thailand or Indonesia (Thanh, 2007). The increasing conjunction of the industry into the regional and international tourism market has imposed a strong pressure for Vietnamese tourism enterprises (Bui, 2009). The standards in terms of marketing, branding and promotion have not met the demand and compete in Vietnams neighboring countries. In responding its relative weakness in competitiveness, the Vietnam tourism industry has increasingly over-exploited natural and human tourism resources cutting development costs in areas such as environmental management and providing poor worker conditions (Thanh, 2007). The deprivation of environmental resources has appeared widely in many tourist destinations such as Cat Ba, Ha Long, Da Nang and Vung Tau.

"Two Kinds" by Amy Tan is about the intricacies and complexities in the relationship between a mother and daughter. Throughout the story, the mother imposes upon her daughter, Jing Mei, her hopes and dreams for her. Jing Mei chooses not what her mother wants of her but only what she wants for herself. She states, "For, unlike my mother, I did not believe I could be anything I wanted to be. I could be only me" (Tan 1). Thus this "battle of wills" between mother and daughter sets the conflict of the story. The theme seems to be about how the expectations of a parent can lead to resentment from the child when the child fails to meet those expectations. The theme is partially set in the opening paragraph with the statement, "My mother believed you could be anything you wanted to be in America" (Tan 1), and again in the second paragraph, when the mother tells the daughter, "Of course you can be prodigy, too" (Tan1). Throughout the story, the mother constantly insists on making of Jing Mei a child prodigy. In the beginning, Jing Mei is excited about the possibility. Langston Hughes and Robert Frost as Role Models Essay

â€Å"The Road Not Taken† and â€Å"Mother to Son† are both parables meant to teach lessons already learned by the experienced narrators. They are meant to teach the lesson that life is precious and once a decision is made it cannot be taken back. Therefore, make decisions careful because they will steer the course of your life. Also, both poems are narrated by a single person, implying that the choices that they have made and the hardships they have endured have been alone. This implies a strength and individuality from either narrator. â€Å"Two roads diverged in a wood, and I — / I took the one less traveled by, / And that has made all the difference.† Robert Frost’s â€Å"The Road Not Taken† is a lyrical poem about the decisions that one must make in life. When a man approaches a fork in the road on which he is traveling, he must choose which path to take. The choice that he makes, as with any choices made in life, affects him in a way that â€Å"has made all the difference.† Thematically, the poem argues that no matter how small a decision is, that decision will affect a person’s life forever. Frost uses the images presented in the poem in a very involved and general way. The paths and the fork no longer refer to their definitions, but instead as keywords in a description of life. Through the poem, Frost is defining life as a series of decisions. Some of these decisions may, at the time, be thought of as insignificant, while others could be thought of as very significant. Frost argues that a decision’s significance at the time is not really important, for any choice will change one’s life. Every day, people, including the narrator of the poem, are presented with â€Å"Two roads† that diverge â€Å"in a yellow wood.† These roads are not concrete or physical, but rather represent choices. The fact that one road is â€Å"grassy and wanted wear† while the other was commonly traversed shows the reader that some choices require one to choose something that is not commonly sought or to do something that is not commonly done. The total of these d ecisions leads people, like the reader, down a new path: a path that the narrator himself created. The narrator comes to the realization that every decision affects him when he says: Two roads diverged in a wood, and I –  I took the one less traveled by,  And that has made all the difference. The narrator also comes to the realization that once a choice is made, it is almost impossible to change that choice: â€Å"Oh, I kept the first for another day! / Yet knowing how way leads on to way, / I doubted if I should ever come back.† Frost recognizes something that everyone should realize. The simple picture of a man deciding which path to follow is suddenly changed into a description of life by the mastery of Frost’s poetic hand. No matter how small a decision appears to be at the time that it is made, that decision will affect a person’s life forever, or as Frost puts it, each and every choice will make â€Å"all the difference.† Langston Hughes makes use of an extended metaphor, the staircase, in â€Å"Mother to Son.† There are a multitude of possibilities as to what lies at the top of the staircase. In the context of the timeframe that this poem was written, the top of the staircase may represent the goals of the blacks. This could, for example, be a successful life. The narrator in the poem is a mother. She describes to her son that no matter what obstacles come in her way, she keeps climbing the stairs. â€Å"Tacks,† â€Å"splinters,† and other obstructions impede her ascent, but she refuses to â€Å"set down on the steps.† The nuisances could represent instances of discrimination. To delve deeper into the metaphors used here, a tack on a staircase is an item that must be placed there by another party. The tacks placed in the mother’s path could then be a specific oppressive incident performed by a white person. A splinter in the staircase is a negative by-product of the  staircase itself. Therefore, the mother’s â€Å"splinters† may have been the results of her actions upon her ongoing journey towards success. The mother also makes reference to â€Å"boards torn up.† If part of the staircase were torn up or missing, then that particular step must be skipped. One small step does not comprise an entire staircase, so it is not necessary to actively use each and every step to make it to the top. Some other parts of the stairs may not have carpeting on them. This would mean that if the mother fell, there is nothing to pad her fall, just the hard wood. Not only would it hurt to stumble and fall, knowing there is no kind of â€Å"safety net† degrades one’s sense of security. Despite the hardships that the mother faces, she keeps climbing towards her goal. She turns corners, unknowing of what might lie just beyond each bend. She continues on to where she is â€Å"sometimes goin’ in the dark.† She cannot see what might happen next, but her only two options are to go further or turn back. At this point, the mother advises her son, â€Å"don’t you turn back.† Clearly, the only thing to do is remain on course up the stairs. She insists that he is not to deviate from walking up those steps. If he stops and settles in one spot, he will find out that it is much harder to continue from this point. Near the end of the poem, the mother is stressing to her son that it is imperative that he strives to reach the top of the stairs, regardless of the difficulties. She has done the same and even to this point she continues to climb. The mother is faced with only the choices of succumbing to a difficult life or triumphing in it. The poem is clearly a testament to her perseverance in that she can tell her son what she has done and that she is still trudging up those stairs. In general, both poems show how there really is no such thing as fate and that making decisions will affect a person for the rest of their lives. In fact, these choices will help guide the course of their lives. They tell us that even if one’s choice seems like the less likely one, someone else has  probably already made this decision. They also tell us that every decision, even a small one, is important.

Henry David Thoreau Essay

Transcendentalism is a very important movement that occurred not only in literature but in life as well. The transcendentalist movement was a movement that was basically the thought of everyone having an over-soul. The over-soul is the thought of a relationship between God, nature, and man. The movement had many different characteristics like individuality, feelings being priority over reason, the fact that nature was divine, and that nature held truths. Transcendentalists used the truths that they observed in the world and in nature to change the way society was and how people see themselves in the world. Although the idea of a utopia was not successful, the movement sparked a change in literature. Emerson and Thoreau are the two people most associated with transcendentalism. They both wrote essays about their experiences in nature and influenced many other writers to do the same (hence the transcendentalist movement). The transcendentalist thought is especially apparent in Walt Whitman and Emily Dickenson’s work. Whitman and Dickenson both show many traits of the movement, but the most apparent trait is individualism. Individualism is often portrayed in Emerson and Thoreau’s work as being equal. Everyone has a soul, inner truth is the only thing that matters, and fulfillment comes from knowing one’s self. In Emerson’s essay Nature, he describes man as being universal and related. In the quote â€Å" . . . that great nature in which we rest . . . that Unity, that Over-Soul, within which every man’s particular being is contained and made one with all other. . . . We live in succession, in division, in parts, in particles. Meantime within man is the soul of the whole; the wise silence; the universal beauty, to which every part and particle is equally related; the eternal ONE. † Emerson is saying that all men have souls and that each soul is a part of an even bigger soul, the universal soul. This is basically saying that we are all equal, but at the same time we are separated because we each have a soul of our own. In another essay, self-reliance, he stated â€Å"Is it so bad, then, to be misunderstood? Pythagoras was misunderstood, and Socrates, and Jesus, and Luther, and Copernicus, and Galileo, and Newton, and every pure and wise spirit that ever took flesh. To be great is to be misunderstood†¦Ã¢â‚¬  In this, he is saying that being misunderstood is being great. This also says that being misunderstood is forgetting what society says you should be or act like and doing what you want to do in order to find yourself and be your own person. By not caring about what others may think about your choices and decisions, you can be your own person and set an example for others to do the same. Not only was Emerson talking about being an individual, he was also adding a bit about your feelings being more important that reason. Thoreau also writes about individualism in his essays. In Walden, Thoreau writes about the experiences and life of his life. He writes â€Å"†¦ if one advances confidently in the direction of his dreams, and endeavors to live the life which he has imagined, he will meet success unexpected in common hours. † This is saying that you should live the way that you want to live and that your inner truth or inner desires are all that matter. Everyone has inner truth and desires and to live the life that you want to live then you should go for the dreams that you have always wanted to come true. This is a prime example of individualism because everyone has dreams and inner truths about the way that they want to live and it is completely up to them to live the way that they want to live. He also addresses individualism in another essay titled Civil Disobedience. He writes â€Å"But, to speak practically and as a citizen, unlike those who call themselves no government men, I ask for, not at once no government, but at once a better government. Let every man make known what kind of government would command his respect, and that will be one step towards obtaining it†¦Ã¢â‚¬  In this, he is encouraging people to take a stand for the rights and respect they deserve. In a way, he is telling people to stop ignoring the unfair government and do something about the way you feel. This is showing again how everyone has inner truth and they should do something to change the way the world is to be better. Thoreau wanted the government to change and so he spoke about what he believed to be true. Like Emerson and Thoreau, Whitman and Dickenson have both used individualism in their works, but Whitman does a better job at portraying it. In Whitman’s poem ‘Song of Myself’, Whitman writes about everyone being equal and having equal opportunities. He states â€Å"I am of old and young, of the foolish as much as the wise, regardless of others, ever regardful of others, maternal as well as paternal, a child as well as a man, stuffed with the stuff that is course, and stuffed with the stuff that is fine †¦ † In this quote he is comparing total opposites to each other. This is a way of showing how even the opposites are the same. Regardless of others, ever regardful of others means that others mean nothing to you, yet others mean everything to you. It’s contradicting, but in a way that says although others mean nothing to you, they affect you in certain ways. Everyone affects you, but you are not everyone. You are simply yourself and that is what I get from what Whitman was describing. In another part of the poem, Whitman says ‘I am as bad as the worst, but thank God, I am as good as the best. ’ This quote stands out because it means no one is better than anyone. Just because you don’t get in trouble doesn’t mean you are any less wrong or less bad. Just because you do good things doesn’t mean you are any better! Being good is simply being good and the same goes for being bad. No one is any better or worst. This means that everyone is equal and has equal opportunities. Dickenson also uses individualism as a theme in some of her works as well. In the poem ‘Heaven Has Different Signs—To Me’, Dickenson writes â€Å"The Rapture of a finished Day—Returning to the West—All these—remind us of the place, That Men call â€Å"paradise†Ã¢â‚¬  In this poem Dickinson is describing what heaven would be like. This quote refers to the end of the day for men. Individualism is living the way you want and reaching fulfillment. This quote shows how men are fulfilled in their lives and of what they call paradise. To me, I don’t think she is writing about heaven, I think she is writing about a utopia. She is writing about a place that everyone is equal and enlightened. Dickinson and Whitman both write about being equal and living the life that you want to lead. Even though they both write about individualism, Whitman portrays it much more and it is more apparent. They were both influenced by the transcendentalist movement, but Dickinson focuses on other traits like how nature is beautiful and simple and the relationship that nature, life, and death have. I believe that there are positive and negative consequences in the safety and quality affecting the delivery of healthcare today. For example, in the past patients used to be on prolonged bed rest following surgical procedures thus the promotion of atelectasis, pneumonia, thrombus formation and so on†¦ Positively, the safety and quality has evolved by enforcing patients to ambulate early, use tri-flows, apply ted hose and sequential compression devices have eliminated the amount of these post operative complications. Also advanced technological inventions, such as laparoscopy, have lessened the extensive hospital stays. According to Dr. Porter-O’Grady, â€Å"Thirty years ago today when somebody entered the health care system for surgery, 86% of the times, they were inpatient. Today, 83% of the people who come through the health care system are outpatients. † However, negatively, after several procedures patients are sent home in a matter of hours and many of these patients wind up in emergency rooms. This was my experience last month, after a diagnostic laparoscopy. At the hospital I felt fine. After a couple of hours when the anesthesia wore off at home, I was in an incredible amount of pain, had urinary retention, and to this day my voice after being intubated is not the same. The staff was professional and comforting but I was disappointed that no one told me about these potential adverse effects. Also, many patients who have cesarean sections and are discharged after 2 to 3 days visit the OB/GYN triage with wound infection, wound dehiscence, and other complications. We are steered by such strict guidelines placed upon us by insurances and Medicaid that we do not have adequate time to monitor the patients for side effects from the procedures and I believe this is a negative impact on the nursing practice. It has become a prominent concern on OB/GYN triage, due to insurance and Medicaid does not pay for re-admits, thus meaning the unit is losing money when it is bombarded with these patients. We need to remember as nurses patients expect us to be proficient and will advocate for them. â€Å"We need to hold on the fact that nurses have been leaders in the health care and society, and that is something we need to act on and emulate and leave for the next generation. † (Mason, 2005) This issue does affect our job because the patients’ experience will be negative if they assume that they are receiving insufficient care.

Psychological Perspectives of Understanding Essay Introduction This booklet will introduce you to the main psychological perspectives to the understanding of a child’s behaviour development. Each perspective will be described in as much detail as possible, and the theorist that are linked to them. The main perspectives are; * Psychodynamic * Freud * Behaviourist * Skinner * Cognitive * Piget * Humanist * Rogers, Maslow, Cooley and mead * Social learning The psychodynamic perspective This perspective is very much based on the early work of Sigmund Freud. It is believed that behaviour is made from a child’s subconscious feelings, which all come from life experiences. It is viewed as a child’s problem as an outward and visible symptom of invisible conflicts. All the conflicts may come from trauma, loss, or from a strained/troubled relationship with parents or carers. Children do not have any inner resources that help them understand their feelings completely so they may be shown in inappropriate and difficult behaviour. Sigmund Freud said that â€Å"when a child’s too painful or too difficult feelings are left untalked about, they leak out in difficult and challenging behaviour or in neurotic symptoms.† The source of a painful feeling is buried under a defensive mechanism that is very hard to find in a child; because of this most children do not understand why they are behaving this way. A psychodynamic assessments are always carried out by psychiatrist as they use techniques that are designed to provide an insight into their past. To do this they use the response of the child to make inferences about sub-conscious motives for behaviour. Once they have understood the child’s behaviour the psychologists will start an intervention which will help the child express their feelings instead of it coming through their behaviour. It was said â€Å"Law of Effect† is the behaviour that leads to strengthened behaviour which is ignored or unsatisfying which is all weakened. Behaviourists claim that all behaviour of children are learned and can be changed by systems, such as rewards or punishment. There are two types of rewards behaviourists use, these are informal and formal. * Informal – acknowledgement or praise * Formal – clear targets for example stickers, tokens or points which all then lead to bigger rewards. The behaviourists also claimed that the behaviour requires a scientific approach which is completely based on objectivity and experimentation. The methods they were use were considered to be unscientific, so instead it was all placed on observations on their behaviour rather than a searches for the cause of the behaviour through the child’s past. Behavioural assessments in schools involve observation and recording of a child’s behaviour. When they are observing it is all taken down on an observation checklist, which includes the following titles; * Antecedent * Behaviour * Consequences All this is then used to form a baseline for a post-intervention can be assessed. The Cognitive perspective This perspective shows how a child’s develops understanding what is around them. This refers to different mental activities such as; * Listening * Speaking * Learning * Understanding All the theories of cognitive development concentrate on developments of  their intellectual skills. All the skills that we have are the ones that have been learnt through cognitive development. If none of the children have cognitive skills then they wouldn’t be able to put past experiences or plan future events, cognitive development is very much concerned with how the mental processes work and develop. There were two psychologists who studied cognitive development, there name was Jean Piaget and Lev Vygotsky. Jean Piaget was a psychologist who looked at a child’s developing their reasoning skills. Piaget carried out detailed observations of them and as his work started taking shape on how our understanding a child’s intellectual skills and as a result of this he has made changes in education. Piaget understood that cognitive developments occurred in stages, his research concentrated on how children learn and start to gain an understanding of their stage of development to be able to learn new concepts. He identified a four-stage process of cognitive development all the way through childhood. He stated that every child would go through each stage but not at the same time, but he also said that some children would sometimes never reach the later stages. The four stages are; * Sensorimotor stage (0-2 years) * Children at very young ages start to learn by their own activity and movement. Everything babies touch or see they put into their mouths or hold them tight and they examine them closely. A child develops an understanding through something called schema. Schema is a mental construction which contains all the information a child has about a particular aspect of the world. * Pre-operational stage (2-7 years) * At this stage children start to show evidence of thinking but it’s not logical thinking, they are not able to perform mental operations. Children will start to use symbolic behaviour such as pretend play, language and drawings. * Concrete operations stage (7-11 years) * At this stage children are able to understand any ideas in a much more logical way but they sometimes still find it hard to understand concepts. * Formal operational stage (age 12 to adult) * At this stage children are able to think in a way which is more abstract and logical way, they can use reasoning skills; they are applying a general principle to a particular situation. Children are more flexible in the way they think. There are two people who have been highly interested in cognitive styles of therapy. Aaron Beck and Albert Ellis, Aaron Beck has used methods of cognitive behavioural therapy to treat many people who have or are suicidal, depressed or may have personality disorders. Whereas Albert Ellis looked at the different ways to change their behaviour my using methods of Rational Emotive Behavioural Therapy, he used this to show his patients that their feelings were results of different habits by conditioning rather than being realistic. Therapists that use this approach use training and role-play techniques to modify their behaviour. The humanist perspective This perspective makes positive aspects of development and growth, this emphasises a person’s unique experiences to a personal thoughts. There are four psychologists that are specialised in this perspective, these four are; * Carl Rogers * Rogers developed the concept on self-esteem. According to him everyone has an idea of what someone’s ideal self should be. He believed that if your image of your self is the same as your ideal self then you have good self-esteem. Rogers said that the development of self-esteem all depends on positive regard from others, the effect of a child’s self-esteem will come from their parents’ unconditional love and affection. Children will start to cope with different situations as they get older, for example a sense of achievement or failure in either sports or their educational skills. Rogers also considered cultural factors, gender and physical attributes to come to his conclusion. * Abraham Maslow * Maslow’s theory is based on individuals that are being motivated through seeking to develop through five levels of need. The most basic needs are physiological which are survival instinct, which is then followed by safety needs, belonging and loving needs, self-esteem needs and at the very top is personals achievements and growth. * Cooley * Cooley proposed â€Å"looking glass† theory, which means that the behaviour from children to others acts like a looking glass which gives us a reflection of ourselves. It raises people’s self-esteem. * Mead * Mead had the view that everyone has two aspects â€Å"I† and â€Å"me†.
